The common RFE mistake
Most deadline-stressed applicants do the same thing: they collect more letters, more screenshots, more reports, more citations, and more pages.
That can help. It can also make the response harder to read.
The officer did not ask for a bigger record. The officer gave you objections. Your job is to answer those objections in the order the officer can process them.
Build this table before writing another paragraph
Use one row per objection. Keep the row short enough that someone can scan it in thirty seconds.
| RFE objection | Case bucket | Best proof | Response sentence |
|---|---|---|---|
| "The record does not establish original contributions of major significance." | EB1A original contribution | Independent adoption, measurable use, field-facing implementation, third-party validation | The response should show who used the work, why it mattered, and how the record proves that impact. |
| "The evidence does not show a leading or critical role." | EB1A leading/critical role | Organization importance, role scope, business or technical outcome, senior corroboration | The response should connect your role to the organization's important work, not just your title. |
| "The proposed endeavor lacks national importance." | NIW Dhanasar prong 1 | Specific endeavor, external need, industry or policy context, beyond-employer value | The response should explain the endeavor as a real project with broader value, not a job description. |
| "The petitioner is not well positioned." | NIW Dhanasar prong 2 | Prior execution, domain expertise, project plan, relevant proof of traction | The response should show why this person can advance this endeavor now. |
Then audit the gaps
After you fill the table, mark each row as one of three states.
- Answered: the exhibit directly answers the objection, and the response sentence makes the connection.
- Partly answered: the exhibit helps, but the response still needs explanation or corroboration.
- Not answered: the record has volume, but no proof that lands on the objection.
Spend your remaining time on the partly answered and not answered rows. Do not polish rows that already work while the weak rows stay exposed.
What to cut
RFE responses often get weaker because the drafter refuses to cut. You can usually remove or downgrade these items:
- Biography paragraphs that do not answer an objection.
- Letters that praise you but do not verify a specific impact claim.
- Long background sections that repeat public facts without linking them to your endeavor or criterion.
- Duplicate screenshots that prove the same point three times.
Keep the record complete. Make the response selective.
When to get help
Use an attorney for legal judgment, deadline handling, status questions, and filing decisions. Use a case-organization tool when the issue is clarity: which objection, which proof, which page, which sentence.
If you are five weeks from deadline, the best paid help is usually not "more drafting." It is a fast read on whether the response map actually answers the RFE.
Bottom line
An RFE response is not a document pile. It is an objection-by-objection decision memo.
If you need a clean map before you send the packet, start with the EB1A RFE objection-to-proof map, then preview the ChatEB1 sample before you buy anything.
