NIW changes the petition structure. A normal EB-2 employer case often depends on PERM and a permanent job offer. NIW asks USCIS to waive that job-offer and labor-certification requirement because the work has national importance, the applicant is well positioned to advance it, and the waiver would benefit the United States.
That can be valuable. It can let a qualified applicant own more of the I-140 strategy instead of waiting on an employer process.
NIW can help with:
